Wednesday, Sep. 20 – 5th Circuit Court of Appeals hears oral arguments in 'Hernandez v. Mesa' – a lawsuit filed by the American Civil Liberties Union on “whether the Constitution extends protection to an individual who is killed on foreign soil, even though that person is standing just a few yards outside the United States,” 9:00 a.m. In 2010, some Mexican youths were playing across a concrete riverbed between El Paso, TX, and Juarez, Mexico. A U.S. Border Patrol agent detained one of the youths, and then, standing on the U.S. side, fatally shot 15-year-old Sergio Hernandez Guereca, who was on the Mexican side, in the head on the. The family alleged the agent violated Hernandez's Fourth and Fifth Amendment rights. A court ruled the Border Patrol agent had qualified for immunity, which meant the family could not sue him. The case went to the U.S. Supreme Court, who vacated the lower courts ruling. Case no. 12-50217.
